DMCA Policy for My Mom Meals

1. Introduction

My Mom Meals respects the intellectual property rights of others and expects users of mymommeals.com (“Website”) to do the same.

This DMCA Policy explains how to submit a copyright infringement notification or counter-notification in accordance with the Digital Millennium Copyright Act (“DMCA”) of the United States.

2. Designated Copyright Agent

If you believe that material available on or through the Website infringes your copyright, please send a written notice to our designated agent:

3. Submitting a DMCA Takedown Notice

Your written notification must include the following information (required by the DMCA):

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyrighted work.

  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.

  3. Identification of the material that is claimed to be infringing or the subject of infringing activity and that is to be removed or access to which is to be disabled, with information reasonably sufficient to permit us to locate the material (e.g., specific URL).

  4. Information reasonably sufficient to allow us to contact you, such as a name, address, telephone number, and email address.

  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  6. A statement that the information in the notification is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.

Failure to include all of the above information may result in a delay in processing your request.

4. Our Response to DMCA Notices

Upon receiving a valid DMCA notice, we may:

  • Remove or disable access to the allegedly infringing material.

  • Notify the user who posted the material, where applicable.

  • Take appropriate actions against repeat infringers, which may include account termination where accounts exist.

5. Submitting a DMCA Counter-Notification

If your content has been removed or disabled as a result of a DMCA notice, and you believe this removal was a mistake or that you have the right to use the material, you may send us a counter-notification containing the following information:

  1. Your physical or electronic signature.

  2. Identification of the material that has been removed or disabled and the location where the material appeared before it was removed or access to it was disabled (e.g., specific URL).

  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

  4. Your name, address, telephone number, and email address.

  5. A statement that you consent to the jurisdiction of the federal court in your judicial district (if you are in the United States), or, if you are outside the United States, that you consent to the jurisdiction of the courts in an appropriate jurisdiction, and that you will accept service of process from the person who provided the original DMCA notice or their agent.

If we receive a valid counter-notification, we may restore the removed material unless the original complainant informs us that they have filed a court action seeking to restrain you from engaging in infringing activity relating to the material.

6. Repeat Infringer Policy

In appropriate circumstances, and at our sole discretion, we may terminate or restrict access for users who are deemed to be repeat infringers.

7. Misrepresentations

Under the DMCA, any person who knowingly misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages (including costs and attorneys’ fees).
